What Apache Trails's governing documents say
This is a 1966 land contract (Agreement of Sale) for Lot 38 in Apache Trails, Mesa, AZ, between the seller (Western Savings and Loan) and the buyers (Floyd and Elizabeth Dawson). It is NOT the community's governing documents (CC&Rs) — it only covers the terms of the purchase, not ongoing homeowner rules.
- Property & purchase price: The property is Lot 38, Apache Trails. The total purchase price is $10,750, payable in monthly installments of $73 or more, including interest at 6.5% per annum, starting September 5, 1966.
- Insurance requirements: The buyer must maintain fire and hazard insurance satisfactory to the seller, with policies for a standard term of three years, and deliver them to the seller. If the buyer fails, the seller may obtain insurance and charge the buyer.
- Default & forfeiture: If the buyer defaults on any payment or obligation, the seller may either sue for specific performance or declare forfeiture after a 10-day notice. Upon forfeiture, the buyer loses any payments made and must surrender possession.
- Late payments & interest: The seller may accept late payments, but if a payment is more than 10 days overdue, the buyer must pay interest at 8% per annum on the delinquent amount from the due date.
