Broadway Manor is a single-family residential homeowner association in Mesa, Arizona. You own your lot subject to covenants and community restrictions enforced by an elected board and architectural review committee. All lot owners automatically become members and must pay annual assessments to maintain common areas and facilities.
- Assessments: Annual assessments are levied uniformly per lot and automatically increase each year by the greater of 5% or the Consumer Price Index, plus any utility or insurance cost increases. Special assessments for capital improvements require a two-thirds member vote.
- Architectural review: The Architectural Committee must approve any visible exterior change, including new structures, alterations, colors, landscaping, and fences. The committee has broad discretion to refuse approval for aesthetic reasons. Requests are deemed approved if the committee does not respond within 30 days.
- Parking & vehicles: All vehicles must be parked in garages, carports, or on driveways—no on-street parking allowed. Motor vehicles over 1 ton, boats, trailers, and aircraft cannot be stored or parked visible from the street or neighboring property, except pickup trucks (≤1 ton, camper ≤7 ft) and mini motor homes (≤7 ft tall, ≤18 ft long) used for regular transportation.
- Lot maintenance: Owners must maintain lawns free of weeds and debris (neatly mowed), keep buildings in good repair with adequate paint, place trash only in covered containers (not visible from neighbors), and remove dead plants. The association may enter exterior areas to inspect compliance.
- Residential use & leasing: Lots are restricted to single-family residential use only—no business or commercial occupancy. Single-family leasing is permitted but subject to all covenant restrictions. Lots cannot be subdivided without board approval.
- Pets: Only a reasonable number of generally recognized domestic pets are allowed, kept solely as pets and not for commercial purposes. Pets must not create unreasonable noise or nuisance. Structures for housing animals must not be visible from neighboring property.
- Party walls & fences: Adjoining lot owners share equally in the maintenance and repair of party walls and fences, with costs divided by lot frontage. If one owner damages a wall, that owner bears the full repair cost. The board resolves cost disputes between adjacent owners.
