Indigo Garden Homes is a townhome community in Mesa, AZ, where residents own individual lots with attached townhouses sharing party walls. The Homeowners Association maintains all exteriors, common areas, water, and private sewers, while owners are responsible for interiors, patios, and termite control. This document is the full set of Covenants, Conditions, and Restrictions (CC&Rs) that govern the community.
- What you own & maintain: You own your townhouse lot and the interior of your home. The HOA handles exterior paint, roofs, gutters, landscaping, walks, and other exterior surfaces (excluding glass). You must maintain the interior, patios, and any fixtures inside the exterior walls. Termite control is your responsibility.
- Assessments & fees: Annual assessments start at a maximum of $500 per lot, adjustable each year by the Consumer Price Index without a vote, or by a two-thirds vote of members for larger increases. Special assessments for capital improvements also require two-thirds approval. Assessments are a personal obligation and a lien on the property, subordinate to first mortgages.
- Architectural review: No building, fence, wall, or exterior alteration may be made without written approval from the Board or an architectural committee. Plans must be submitted showing design, materials, and location; if no decision within 30 days, approval is deemed given.
- Use restrictions: The property is for residential use only. No business activities, temporary structures, trailers, tents, or outbuildings. No signs except one 'for sale' or 'for rent' sign of up to 5 square feet. No exterior TV or radio antennas without prior approval. Clotheslines must be confined to patios and garbage cans screened from view.
- Pets: Dogs, cats, or other household pets are allowed, but they may not be kept, bred, or maintained for commercial purposes. No livestock or poultry.
- Parking & vehicles: No abandoned or inoperable vehicles may be stored or kept on any lot, private street, or drive if visible from other lots or streets.
- Party walls: Walls separating adjoining townhouses are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall. If a wall is destroyed, any owner may restore it and others must contribute. Damage caused by an owner's negligence is that owner's sole cost.
- Common area & amenities: Common areas are owned by the Association for the use of all owners. The HOA may charge admission fees for recreational facilities, suspend usage rights for nonpayment or rule violations (up to 60 days), and dedicate common areas with a two-thirds vote. Owners may delegate use to family, tenants, or contract purchasers residing on the property.
