Villa Legante Reamended is a single-family residential subdivision in Tempe, AZ, governed by a homeowners’ association (HOA). These amended deed restrictions bind all lot owners to rules on use, appearance, parking, and more. The HOA maintains common areas and enforces these covenants.
- Permitted use: Lots are for single-family residential use only. No business, commercial activity, or institutions (e.g., care facilities) are allowed. Only household pets are permitted; no livestock or poultry.
- Signs: One 'For Rent' or 'For Sale' sign no larger than 6 square feet is allowed on the front and one on the rear of each lot. No other commercial or billboard signs are permitted.
- Parking & vehicles: Trucks, campers, RVs, trailers, boats, and similar equipment must be stored inside a garage or carport. Vehicles too large to fit inside may not stay within the subdivision for more than 12 days per year. Auto repairs or restorations taking more than 7 days are prohibited unless performed in a closed garage. Violating vehicles may be removed and stored at the owner's expense.
- Maintenance & appearance: Lots must be kept free of rubbish, trash, and garbage. Garbage cans, incinerators, clotheslines, and storage areas must be screened from view. All buildings and masonry fences must be painted Navajo White or Desert White; iron fences must be painted black. The board may repaint violations and charge the owner.
- Architectural & improvement approval: No building, fence, wall, or other structure may be erected or altered without prior approval of the board of directors. Plans and specifications must be submitted; the board has 15 days to approve or disapprove. If no response within 15 days, the request is deemed approved. Unapproved improvements may be removed at the owner's expense.
- Party walls: Walls built on lot dividing lines are party walls, with shared maintenance obligations. Damage caused by one owner must be repaired by that owner; damage from other causes is shared equally. Disputes are submitted to the board or arbitration.
- Assessments & liens: The board sets regular assessments (semi-annually or other intervals). Regular assessments cannot increase more than 15% in any year without consent of 51% of lot owners. Special assessments require 51% owner consent. Unpaid assessments accrue 2% monthly interest and become a lien on the lot. The owner may lose voting and common area privileges until the lien is satisfied.
- Transfer & lease approval: The board has a right of first refusal on any sale, transfer, or lease. The owner must give written notice with an application from the proposed transferee. The board must approve or disapprove within 15 days; failure to respond within 15 days means approval. The instrument of transfer must record board approval or an affidavit of non-response. This right does not apply to foreclosure sales or deeds in lieu.
