What Northridge Manor's governing documents say
Northridge Manor Unit Two is a single-family home subdivision in Mesa, AZ, governed by a Declaration of Restrictions recorded in 1980. These covenants run with the land and apply to all lot owners, requiring approval for exterior changes and limiting uses to residential purposes. The restrictions are enforceable by any lot owner and automatically renew every 10 years unless a majority votes to amend or revoke.
- Land use & building type: Lots may be used only for residential purposes. Each lot may have one detached single-family dwelling, no more than 2.5 stories, plus a private two-car garage. No business, trade, hospital, or sanitarium is allowed.
- Architectural review: No building or alteration may begin until plans and specifications are approved in writing by the Architectural Control Committee. The committee must approve or disapprove within 30 days of submission; if no response, approval is deemed given.
- Minimum dwelling size: The floor area of the dwelling (excluding porches, garages, carports, and patios) must be at least 1,000 square feet unless the committee approves a smaller size.
- Setbacks & fences: Buildings must be at least 20 feet from the front lot line, 5 feet from interior side lines, and 10 feet from side lines adjacent to a street. Fences cannot exceed 6 feet in height on rear or side lot lines; fences within the front or side street setback cannot exceed 2 feet 6 inches.
- Pets & animals: No livestock, poultry, or commercial breeding is permitted. Dogs, cats, and other household pets are allowed if not kept for commercial purposes.
- Parking & vehicles: Overnight parking of trucks, pickup trucks, or trailers on the street is prohibited. Only passenger cars and pickup trucks may be parked in open carports. No abandoned or inoperable vehicles may be stored where visible from other lots or streets.
- Property maintenance: All lots must be kept free of rubbish and weeds, with lawns maintained in a neat condition. Drainage easements must not be obstructed, and owners are responsible for repairing any damage caused by obstruction.
- Term & enforcement: The covenants run with the land until August 8, 2008, and automatically renew for successive 10-year periods unless a majority of lot owners amend or revoke them by recorded written instrument. Any lot owner may enforce these restrictions through legal action.
