Merit Park I is a commercial/industrial development in Mesa, AZ, governed by a Declaration of Covenants, Conditions and Restrictions. Owners of lots must comply with architectural and landscaping standards, use restrictions, and pay assessments to the Owners' Association. This document is primarily for businesses or commercial property owners, not residential homeowners.
- Architectural review: All improvements and landscaping require prior approval by the Architectural Committee. Plans must be submitted and are deemed approved if not acted upon within 30 days (or 60 days if an extension is requested). The committee may charge review fees.
- Lot use & maintenance: Lots must be kept safe, clean, and in good repair. No nuisance activities (dust, odor, noise) are allowed. Owners must remove rubbish, and during construction, materials and debris must be stored neatly and cleaned up within 90 days after completion.
- Setbacks & building limits: Improvements cannot exceed 40 feet in height or two stories. Setbacks: 10 feet from residential property lines, 25 feet from Nido Street, and 25 feet from Alma School and Guadalupe Road.
- Landscaping requirements: Landscaping must be installed and maintained by lot owners, using long-lived, evergreen varieties. Landscape buffer strips (25 feet from streets, 5 feet from neighboring property) must be landscaped, with maintenance by the Owners' Association funded through assessments. Automatic underground irrigation is required.
- Signage: Exterior signs require Architectural Committee approval. Each lot may have one freestanding or pylon sign per street frontage (max 4 pylon signs total). Freestanding signs max 24 sq ft and 5 ft high; pylon signs max 100 sq ft and 20 ft high. No roof-mounted signs. No signs on vehicles parked within view of public streets.
- Parking & storage: Off-street parking must be provided as required by law, with paved surfaces. Loading/unloading areas must be on side or rear and screened. Outdoor storage must be inside a closed building or behind an approved visual barrier, with nothing projecting above the screen.
- Assessments & enforcement: Owners pay assessments based on lot size to fund the Owners' Association (landscape buffer strips, perimeter walls, insurance, etc.). Unpaid assessments accrue interest and become a lien on the lot. Violations can be corrected by the association at owner expense after 15 days' notice.
- Lot subdivision & combination: Minimum lot size is 18,000 sq ft. Lots may be combined, or subdivided (with Architectural Committee and City approval). Horizontal property regimes (condominiums) are allowed. Lot 1 cannot be split.
