This is a set of restrictive covenants for Palm Gardens of Mesa Unit Six, a single-family residential subdivision in Mesa, AZ. These covenants run with the land and are binding on all lot owners. They set rules for what can be built on each lot, setbacks, and other property uses. There is no homeowners association mentioned; enforcement is through court action by lot owners.
- Property use: All lots are designated as residential lots. No structure may be used for residential purposes until a dwelling is constructed, and no garage or other building may be used as a residence except for guest or servant quarters.
- Minimum dwelling size: Each single-family dwelling must have a ground floor area of at least 1,250 square feet, excluding open porches and attached garages.
- Setback requirements: Front walls must be between 20 and 65 feet from the front property line. Side walls must be at least 5 feet from the side lot line, except open carports with frame storage may be 3 feet from the side lot line. Rear garages or guest houses on the rear third of a lot are exempt from side setbacks.
- Fence & wall restrictions: Solid walls or fences over 3 feet high are prohibited within 20 feet of the front lot line or closer to the street than the front wall of the dwelling. Side and rear fences or walls may not exceed 6 feet in height. Hedges over 3 feet are not allowed within 20 feet of the front lot line.
- Livestock & poultry: No livestock or poultry may be kept on any lot.
- Duration & amendment: These covenants run until January 1, 1982, and automatically extend for successive ten-year periods unless a majority of lot owners vote to change them in whole or in part.
