La Mariposa Villas Four is a townhouse/villa community in Mesa, Arizona where you own your individual unit and share ownership of common grounds (maintained by a local homeowners association). You are automatically a member of both the local association and an overlying Master Association, and are subject to assessments from both. This is the full Amended and Restated Declaration as of 2017.
- What you own & maintain: You own your villa interior and are responsible for painting, repair, and replacement of your home's exterior surfaces; you also maintain your own patio and fixtures from where utility lines enter the exterior walls inward. The association maintains common areas, yards, exterior trees, shrubs, shared party walls, and curbs.
- Assessments & fees: Annual assessments fund maintenance (maximum $720 per year initially); the Board can increase them up to 5% annually without a vote, or more with a 2/3 owner vote. Special assessments for capital improvements also require a 2/3 vote. Unpaid assessments accrue 6% annual interest and become a lien on your property.
- Architectural review: Most exterior changes—including painting, repairs, fences, decks, antennas, and landscaping—require written Board approval (or approval from a designated architectural committee). The Board has 30 days to respond; silence equals approval. One real-estate sign (max 5 sq ft) is allowed during sale or rental.
- Use restrictions: Property is restricted to residential single-family use only. No boats, RVs, campers, or similar vehicles may be stored or parked on your lot or common areas except in association-designated spots. No vehicles may be kept on blocks or jacks.
- Pets: Dogs, cats, and other household pets are allowed provided they are kept for non-commercial purposes only.
- Party walls & shared maintenance: Walls on the boundary between your lot and a neighbor's are party walls. The cost of repair and maintenance is shared equally between users. If you negligently damage a party wall, you pay all repair costs. Fire or other casualty damage requires proportional contribution from other users if they later use the wall.
- Damage & liability: If you cause damage to common elements, the association can repair it and bill you. If you damage your villa's exterior, you must start repair/rebuilding within 60 days; if you fail to complete it within 6 months, the association can repair it and place a lien on your property for the cost. These repair liens are subordinate to first mortgages but survive foreclosure.
- Voting rights & suspensions: You have one vote per lot owned. The association can suspend your voting rights and access to recreational facilities if you fail to pay assessments or violate the rules (after notice and a hearing opportunity). Voting rights are reinstated once arrears are paid or violations are cured.
