What La Casa Mesa Condominium's governing documents say
This is the Amended and Restated Condominium Declaration for La Casa Mesa Condominium in Mesa, Arizona, a 86-unit condominium community. It governs the rights and obligations of unit owners, residents, and tenants, covering use restrictions, maintenance duties, assessment rules, and common element policies.
- Use & occupancy restrictions: Units must be used for residential purposes only. Home businesses are allowed only if not detectable from outside, comply with zoning, involve no customer visits, and do not create a nuisance. No time-sharing arrangements for periods less than 180 consecutive days.
- Pets: No more than two 'Permitted Pets' per unit, defined as a household bird, dog, or cat. Dogs must be leashed on common elements and feces must be removed. Board may adopt rules on pet height/weight with member vote if over 50% approval.
- Parking & vehicles: No trucks, trailers, campers, boats, or similar vehicles may be parked on the property. Inoperable vehicles prohibited. Parking only in designated spaces; assigned Limited Common Element spaces must be used. No vehicle repairs except emergencies.
- Alterations & appearance: Nonstructural interior alterations are allowed without board approval, but structural changes require prior written approval from the board and a licensed engineer. Any alteration visible from the exterior (e.g., window coverings, patio furniture, antennas, signs) requires board approval. No reflective window materials, outside clotheslines, or exterior antennas without approval. Patios: no furniture or floor coverings without board approval.
- Maintenance responsibilities: The association maintains all common elements (including patios' walls). Unit owners maintain their unit's interior and certain Limited Common Elements such as exterior doors, windows, and interior of patios. Owners are liable for damage caused by their negligence.
- Assessments & fees: Common expense assessments are allocated equally (1/86th per unit). Special assessments require approval of 2/3 of voting members. A transfer fee is due upon unit sale, set by the board. Delinquent assessments accrue interest and late fees, and are secured by an assessment lien subordinate to first mortgages.
- Leasing & rentals: Leasing is permitted, but no minimum lease term is stated in this document. Lessees have the right to use common elements during the lease term, and unit owners may not use common elements during that period. All tenants must comply with the declaration and rules.
- Noise & nuisance: No nuisance or offensive activity allowed. Floor coverings in units must use sound-control underlayment; hard surfaces (tile, wood) require board approval. Noise from stereos, TVs, and musical instruments must comply with rules and city ordinances.
