What North Miller Estates's governing documents say
North Miller Estates is a single-family home subdivision in Mesa, AZ, governed by a 1964 Declaration of Restrictions that runs with the land. The rules apply to all lot owners and are designed to maintain a residential character with minimum construction standards and setbacks.
- Residential use only: All lots are restricted to residential use. No house trailers may be used for residential purposes.
- Minimum dwelling size: Single-family dwellings must have at least 1,250 square feet of ground floor area, excluding open porches, pergolas, and attached garages. Construction must be consistent with choice residential districts.
- Setbacks and building placement: Front walls must be between 20 and 65 feet from the front property line. Side walls must be at least 5 feet from side lot lines (3 feet for open carports with frame storage). Rear one-third of lot exceptions apply for garages or guest houses.
- Fences and walls: No solid wall or fence over 3.5 feet high is allowed closer to the front street line than the front wall of the dwelling. Side and rear fences or walls (other than building walls) may not exceed 6 feet in height. Hedges over 3.5 feet are prohibited within 20 feet of the front lot line.
- No livestock or poultry: Livestock and poultry are prohibited on any lot.
- Duration and amendments: These restrictions run until January 1, 1980, and then automatically extend for successive 10-year periods unless a majority of lot owners vote to change them.
- What this document doesn't cover: The document does not address leasing, rentals, pets (except livestock), parking, architectural review beyond basic setbacks and size, or any association with ongoing fees or a formal HOA board.
