Mesa Starlite Gardens is a single-family residential subdivision in Mesa, AZ, governed by a Declaration of Restrictions recorded in 1962. These restrictions run with the land and bind all current and future lot owners, covering what you can build, how you can use your property, and basic standards. An architectural review committee oversees new construction and modifications.
- Allowed use: Lots are for single-family residential use only. No business, hospital, sanitarium, hotel, duplex, apartment, or boarding house is permitted. No trailer, tent, shack, or garage may be used as a residence.
- Minimum dwelling size: Any dwelling must have a ground floor area of at least 1,400 square feet, excluding open porches, pergolas, and attached garages.
- Setbacks: Buildings must be at least 30 feet from the front property line, 30 feet from the rear property line, 10 feet from a side street line, and 7 feet from an interior side lot line (except attached garages or carports, which may be on the interior line if placed more than 75 feet from the front property line).
- Pets: Household pets (dogs, cats, etc.) are allowed but may not be kept, bred, or maintained for any commercial purpose. No livestock or poultry.
- Signs: Only one sign of up to 5 square feet advertising the property for sale or rent is allowed, plus builder signs during construction and sales.
- Architectural review: No structure may be built or altered until the design, location, and materials are approved in writing by a committee (initially appointed by the developer, later elected by lot owners). If no committee exists or no decision is made within 30 days of a written request, approval is not required but the building must still comply with all restrictions and be in harmony with the neighborhood.
- Effective period & amendments: These restrictions were originally effective until June 1, 1992, and automatically renew for successive 10-year periods unless a majority of lot owners votes to change them.
