Three Fountains of Mesa is a condominium community in Mesa, AZ, established in 1973 — you own your individual unit and an undivided interest in the common areas, which are managed by a management committee. The declaration and by-laws govern all owners, tenants, and occupants, binding them to its rules upon acquisition or occupancy.
- What you own & maintain: You own the interior of your unit, including plumbing, appliances, and HVAC, and you must keep it in good repair. The association maintains all common areas and facilities (e.g., roofs, exterior walls, grounds, pools, clubhouse). You are responsible for the patios, carports, and storage rooms attached to your unit, and no structural alterations or exterior painting may be done without written permission.
- Assessments & fees: Each unit owner pays a monthly assessment based on their percentage of undivided ownership in the common areas (see Exhibit B for exact percentages). Special assessments for capital improvements exceeding $2,500 require approval by 75% of unit owners. Late payments accrue interest at 10% per year, and unpaid assessments become a lien on the unit, subject to foreclosure.
- Leasing & rentals: You must give the management committee 10 days' advance written notice before selling or leasing your unit, including the proposed purchaser/tenant and terms. The committee has a right of first refusal to buy or lease the unit on the same terms; if the price/rent is deemed unreasonable, it may be determined by a panel of three appraisers.
- Use restrictions: Units may be occupied only as a private residence by a family, servants, and guests. No use that is a source of annoyance, interferes with peaceful enjoyment, or increases insurance rates is allowed. The common areas may only be used for their intended purposes.
- Insurance: The management committee must maintain fire and extended coverage insurance for full replacement value, as well as liability insurance with minimum limits of $100,000/$300,000 for bodily injury and $10,000 for property damage. Each owner may obtain additional insurance, but cannot reduce the amount collectible by the committee.
- Amendments: The declaration may be amended by a vote of unit owners representing at least two-thirds (2/3) of the undivided interests in the common areas, with a duly recorded instrument. The developer retains certain amendment rights until all phases are completed.
