This is a 1984 amendment to the governing documents for Three Fountains of Arizona, a condominium (horizontal property regime) community in Mesa, Arizona. It updates rules on assessment collection and late fees, but does not contain the full set of community rules.
- Assessment liens & personal obligation: Annual and special assessments, plus interest, late charges, costs, and attorneys' fees, are a continuing lien on the unit and a personal obligation of the owner who was the owner when the assessment fell due.
- Late fees & collection: If an assessment is unpaid 30 days after due, a $25 late charge is assessed for the first month, then $50 per additional month (max $50/month total). The association may sue to recover unpaid assessments, foreclose the lien, and recover interest, collection costs, and attorneys' fees.
- Rent diversion for delinquent assessments: If an owner is one month delinquent on assessments and has rented or sublet the unit, the association may demand and receive rent from the tenant to cover the back assessments; the tenant's payment to the association discharges the tenant's rent obligation to the owner.
