What Stapley Court North's governing documents say
Stapley Court North is a patio home community in Mesa, AZ — you own your lot and home, but share common areas and party walls with neighbors, governed by the Stapley Court North Homeowners Association. This document (the Declaration of Covenants, Conditions, and Restrictions) outlines what you own, maintain, and can do with your property.
- Party walls: Walls built on the dividing line between lots are shared party walls. Owners sharing a wall split the cost of reasonable repair and maintenance. No alterations or penetrations are allowed through the wall.
- Architectural review: Any exterior change — including structures, painting, landscaping, fences, antennas, solar devices, and signs — requires prior written approval from the Architectural Control Committee. Plans are reviewed for design harmony within 30 days.
- Exterior maintenance: Each owner is responsible for maintaining their patio home's exterior: roof, gutters, paint, walks, glass, trees, shrubs, and grass. The association maintains common areas, landscaping, and the swimming pool.
- Assessments & liens: All owners must pay annual and special assessments to the association. Unpaid assessments become a lien on the property, which can be foreclosed like a mortgage. The association can also charge interest and attorney fees.
- Residential use only: Lots may only be used for one private residence. No business, professional, or commercial activity is allowed. Temporary structures (tents, trailers, mobile homes) are prohibited except during construction with permission.
- Parking & vehicles: Recreational vehicles, boats, trailers, trucks over 3/4 ton, and commercial vehicles cannot be parked on streets or lots unless inside an enclosed structure or a designated area. No vehicle repairs or dismantling outside an enclosure.
- Living environment standards: Lots must be kept clean and free of weeds, trash, and unsightly conditions. No exterior noise devices (except security), no visible antennas or satellite dishes, and no noxious activities. Garage doors must stay closed except when entering/exiting.
- Leasing & rentals: Owners may lease their patio home; tenants have the right to use common areas. No minimum lease term is stated in this document.
