What Skyview Mesa's governing documents say
Skyview Mesa Unit One Association is a homeowners association (HOA) in Mesa, AZ. These By-Laws govern the corporation that manages the association for owners of lots in the subdivision. They outline the board structure, meeting rules, assessment collection, and general governance.
- Governance & board: A board of at least 9 directors manages the association; directors are homeowners (non-homeowners may serve with permission). Directors serve staggered 3-year terms, are elected by members, and may be removed by majority vote. The board meets monthly; a quorum is 1/3 of directors.
- Assessments & liens: Each lot owner must pay annual and special assessments. Unpaid assessments become delinquent after 30 days, accrue 7% annual interest, and the association may foreclose the lien or sue the owner personally. The board sets assessment amounts at least 30 days before the annual period.
- Common area use & enforcement: Owners, their family, tenants, and contract purchasers may use the common area. The board can adopt rules and suspend a member's voting rights and common area access for up to 60 days for rule violations, or indefinitely for nonpayment of assessments.
- Meetings & voting: Annual member meetings are held each June; special meetings can be called by the president, board, or upon written request of voting members. A quorum is 1/10 of votes (in person or by proxy). Members may vote by proxy. Cumulative voting is not permitted.
- Books & records: The association's books, records, and papers are available for inspection by any member during reasonable business hours. Copies of governing documents may be purchased at the principal office.
- Architectural control: An Architectural Control Committee is required by these By-Laws, but specific design or approval rules are not included here; they appear in the Declaration or separate guidelines.
- What this document doesn't cover: These By-Laws do not address leasing restrictions, pet limits, parking rules, age restrictions, or detailed property use standards. Those are found in the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) and any separately adopted rules.
