What Superstition Canyon's governing documents say
Superstition Canyon is a standard single-family homeowner association (HOA) in Mesa, AZ. The HOA maintains the common drainage areas and Tract A, funded by annual and special assessments on each lot. Owners are responsible for their own lots and for landscaping within drainage easements on their property.
- What you own & maintain: You own your lot and are responsible for its maintenance, including landscaping within drainage easements on your lot. The association handles maintenance of the common drainage areas and Tract A (landscaped common area).
- Assessments & fees: Each lot pays a percentage of the annual budget based on its acreage. Special assessments require 80% owner approval. Assessments are a lien on the lot and may bear interest at Prime Rate plus 10% if unpaid.
- Voting & governance: Each lot gets votes based on its acreage divided by 13.291 (the total acreage of all lots). Decisions need a majority of votes present at a meeting with a quorum (80% initially, 60% at a second meeting). Unanimous vote required to convey or encumber Tract A.
- Insurance: The association carries liability insurance ($1M per person, $1M per occurrence, $50K property damage), replacement cost coverage on Tract A improvements, and fidelity coverage. Each owner must get their own insurance for their lot.
- What this document doesn't cover: This declaration does not address leasing/rentals, pets, age restrictions, architectural review, parking, or use restrictions beyond drainage and maintenance. Those may be covered in separate rules or amendments.
