Toni Estates is a single-family home subdivision in Mesa, AZ, governed by restrictive covenants that run with the land. These rules apply to all lot owners and are enforceable by neighboring owners. The document does not establish a homeowners association, common areas, or fees.
- Land use & building type: Lots are for residential use only. Each lot may have one detached single-family dwelling up to 2½ stories, plus a private two-car garage. No business, trade, hospital, or sanitarium is allowed.
- Architectural review & minimum size: Plans and specifications for any building (including alterations) must be approved by the Architectural Control Committee for quality, harmony, and location. The committee has 30 days to respond; if no action, approval is deemed given. Dwelling living area (excluding porches, garages, etc.) must be at least 960 square feet unless the committee approves otherwise. Prefabricated or temporary structures are generally prohibited.
- Setbacks & fences: Buildings must be at least 20 feet from the front lot line, 5 feet from interior side lot lines, and 10 feet from side lot lines adjacent to a street. Detached garages and accessory buildings in the rear half of the lot need only meet county requirements. Fences over 6 feet are not allowed; within front or side setback areas, fences cannot exceed 2.5 feet; side lot line fences cannot exceed 6 feet.
- Nuisances & livestock: No noxious or offensive activities are permitted. Livestock and poultry are generally prohibited, but dogs, cats, or other household pets are allowed if not kept for commercial purposes. Horses may be kept for single-family use with county approval and committee approval.
- Parking & vehicles: No overnight parking of trucks, pickup trucks, or trailers is allowed in the street. Only passenger cars and pickup trucks may be parked in open carports. Abandoned or inoperable vehicles may not be stored on any lot or private street where visible from other lots or streets.
- Care of property & compliance: Lots must be kept free of rubbish, weeds, and litter. Improved properties must maintain neat yards and grounds. If an owner fails to maintain, neighbors acting in concert may clean the lot and file a lien. Construction must be completed without delay (except for unavoidable causes). No temporary structures, trailers, tents, etc., may be used as residences.
- Term & enforcement: These covenants run with the land until 2008, then automatically renew for successive 10-year periods unless a majority of lot owners amend or revoke them. Any owner may sue to enforce the restrictions or recover damages.
