What Val Vista Center's governing documents say
Val Vista Center is a commercial shopping center in Mesa, AZ, governed by this Declaration of Covenants, Conditions, Restrictions and Easements. The rules bind all owners and occupants of pads/parcels within the property, requiring compliance with use restrictions, architectural review, and shared maintenance. This is not a residential community—it is designed for retail, office, and service businesses.
- Permitted and restricted uses: Property must be used solely for commercial purposes such as retail, office, financial, restaurant, and service establishments. Restricted uses include theaters, skating rinks, bowling alleys, pawn shops, massage parlors, adult bookstores, electronic game rooms, and lodging. No pad may be used as a general grocery or drug store for 36 months (or while a major user operates such a store) without declarant's consent.
- Architectural review: All improvements require approval from an Architectural Design Review Committee, which reviews plans for exterior design, materials, landscaping, signage, and conformity to the site plan. The committee has up to 20 days to approve or disapprove; failure to act constitutes approval. Fees for review are paid by the submitting owner.
- Building size and height limits: Buildings are limited to one story or 28 feet in height. Allowed gross floor areas are specified per pad: Declarant's Parcel 102,976 sq ft, Bank Pad 5,500 sq ft (expandable to 7,000), Pad A 3,500, Pad B 3,000, Pad C 4,500. Floor area adjustments require amendment and approval of affected owners.
- Common areas and maintenance: Common areas include parking, roadways, sidewalks, landscaping, and utilities. Owners share responsibility for common expenses (maintenance, insurance, taxes) as detailed in the declaration. Special assessments may be levied. Each owner must maintain their pad/parcel in clean, orderly condition.
- Easements and parking: Non-exclusive easements over common areas are granted for ingress/egress, pedestrian traffic, utilities, and parking. No walls or barriers may obstruct access. Delivery vehicles must park only in designated loading areas. All parking must comply with the site plan.
- Signage: Signs are subject to committee approval and must conform to established sign criteria. No outdoor displays or advertising that constitutes a nuisance (e.g., flashing lights, loudspeakers) are permitted.
- Enforcement and amendments: The declarant or committee may enforce rules through injunctions or removal of non-compliant improvements. Amendments require a recorded document approved by the declarant and affected owners. Covenants run with the land and are perpetual.
