What Vista Estancia's governing documents say
Vista Estancia is a standard single-family home HOA in Mesa, AZ. This document is the full set of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners. It covers architectural controls, land use, assessments, and common area maintenance. If you buy a home here, you must follow these rules and pay assessments to the homeowners association.
- Architectural review: All exterior changes, including construction, landscaping, fences, paint, and solar panels, require prior written approval from the Architectural Committee. The committee has 60 days to respond; if no response, approval is deemed granted. Minimum dwelling size is 3,500 square feet, and architectural styles are limited to Santa Fe, Spanish Territorial, Spanish Colonial, Mediterranean, or Santa Barbara.
- Pets: No more than three household pets (cats, dogs, etc.) per lot. No animals may be kept for commercial purposes, and dogs must not stray onto other lots.
- Parking & vehicles: All vehicles should be parked in the garage. Two vehicles may park on the driveway. No street parking for more than 4 hours. No mobile homes, motor homes, trailers, boats, or recreational vehicles are allowed without Architectural Committee approval. No abandoned or junked vehicles may be kept outside the garage.
- Landscaping & maintenance: Front yard landscaping (including at least two 36-inch box trees with 8 total caliper inches and a sprinkler system) must be completed within 90 days of dwelling completion. Owners must keep lots free of debris and weeds. The Association may enter to correct violations and charge the owner.
- Use restrictions: Lots are restricted to single-family residential use. No business or commercial activity is allowed unless it is home-based and not detectable from outside, complies with zoning, and doesn't increase HOA insurance or create nuisance. No group homes, hospitals, or sanitariums. Timeshares are prohibited.
- Assessments & fees: Each lot owner pays annual regular assessments (initially capped at $1,500 per year, payable quarterly; can increase up to 10% or CPI annually without member vote). Special assessments require majority vote. Late payments incur a $25 charge plus interest at 12% or prime +2%. Delinquent assessments become a lien on the property.
- Fences & walls: Fences must match the architectural style of the dwelling. Maximum fence height is 7 feet; front/side lot line fences may not exceed 3 feet. Boundary fences (on property lines) cost is shared equally between adjacent owners. Retaining walls required when elevation difference >2 feet, also shared.
- Construction & completion: Construction must start and be completed within 12 months unless delayed by circumstances beyond the owner's control. Only one detached single-family dwelling per lot, but multiple lots may be combined. No temporary structures or mobile homes allowed as residences.
