Villas Mesa II is a townhouse community in Mesa, Arizona where you own your individual unit and maintain its interior; the homeowners association maintains common areas (pool, tennis court, grounds) through monthly assessments. Rules are set by a 5-member elected board and apply equally to owners and tenants.
- Fees & payment: Maintenance fee is $95/month (as of 1994), due by the 15th to avoid delinquency. At 60 days overdue, a $60 lien is filed and a $25 demand letter sent. At 90 days overdue, the association files civil court action at the owner's expense. Delinquency of 30+ days suspends voting rights.
- What you own & maintain: You own and are responsible for all interior maintenance—plumbing, electrical wiring, drywall, flooring, windows, appliances. The association maintains common grounds, pool, tennis court, and building exteriors.
- Parking & vehicles: Two spaces per unit (one covered, one uncovered). Vehicles parked outside your space are towed at owner's expense. Minor repairs allowed in your space only, completed within 24 hours. Motorcycles and bicycles must be parked in your space or patio. Abandoned vehicles (inoperable, disrepaired, or expired tags) are tagged with 24 hours' notice before towing.
- Pets: Dogs and cats allowed but must be continuously leashed and cannot be bred commercially. Owners must clean up pet waste immediately in common areas ($50 fine per incident) and keep pets inside when absent.
- Exterior changes & personalization: Board approval required for any exterior modification—painting doors/shutters, structures, patio covers, or antennas. Patio covers also need a City of Mesa building permit. Potted plants and holiday decorations do not require approval. Violations have 30 days to be remedied before the association charges owners for corrections.
- Pool & tennis court: Open 10 a.m. to 9 p.m. for children 14 and under. Children under 14 or non-swimmers must have adult supervision; no one under 18 may swim alone. No lifeguard on duty; swim at your own risk. No glass, pets, or intoxicated persons allowed.
- Tenants & rentals: Tenants must follow all community rules, though the association is not responsible for notifying them. Owners should include the rules in lease agreements.
- Common area conduct & rules: Speed limit 10 mph on roads. Water use and car washing prohibited ($25 fine). No business operations allowed. Play areas prohibit baseball, archery, and BB guns. After 9 p.m., no shouting or nuisance noise. Trash must be bagged in designated dumpsters (rocks, paint, building materials prohibited; $50+ fine).
