This document establishes the rights and obligations of lot owners — the rules bind every owner and their tenants, guests, and successors.
- What & who the rules bind: The Declaration applies to all 4 lots in North Mockingbird Court. Every lot owner automatically becomes a member of the Association, which has the power to levy assessments, enforce rules, and maintain the common area (landscaping, walkways, lighting, etc.). Owners are personally responsible for the maintenance, upkeep, and repair of their own lot and improvements.
- Membership & assessments: Each lot owner is a member of the Association with one vote per lot (except Declarant, who holds three votes per lot until certain conditions are met). The Association charges annual assessments to cover common area maintenance, reserves, and insurance. Special assessments for capital improvements require approval of 3/4 of the Board and 3/4 of members. Unpaid assessments accrue 10% annual interest and become a lien on the lot, subordinate only to first mortgages; the Association can foreclose.
- Use restrictions (single-family & leasing): Each lot must be used exclusively for single-family residential purposes. No nonresidential use or gainful occupation is permitted. The entire lot may be leased to a single family, but the document does not specify a minimum lease term. A residence must be occupied as a single-family dwelling; no trailers, mobile homes, or temporary structures may be used as a residence.
- Pets & animals: Only a 'reasonable number' of generally recognized house or yard pets are allowed, kept solely as domestic pets and not for commercial purposes. Pets must not create unreasonable noise or become a nuisance. The Architectural Committee may determine what qualifies as a pet and whether the number is reasonable. Pet structures must not be 'Visible from Neighboring Property' (defined as visible to a 6-foot-tall person on neighboring property at the same elevation).
- Architectural review & improvements: An Architectural Committee (initially appointed by Declarant, later elected by owners) must approve all exterior changes, including buildings, fences, walls, landscaping, colors, and even antennas, signs, and tennis courts. Plans must be submitted in writing; if the Committee takes no action within 30 days, approval is deemed given. Variances may be granted for hardship. The Committee's decisions are final and not subject to damages claims.
- Vehicles & parking: Mobile homes, boats, recreational vehicles, trailers, campers, trucks, and similar vehicles may not be kept on any lot or street in a manner visible from neighboring property, without written Committee approval. Garages must be used only for parking and storage (not converted to living space). Only operating automobiles may be parked in uncovered areas. Temporary construction shelters are exempt.
