Orchard Manor is an 8-unit condominium community in Paradise Valley, AZ, governed by a Declaration of Horizontal Property Regime (condominium). You own your individual unit and an undivided 1/8 interest in the common elements, which the association maintains and insures. This document establishes the rules for owners, occupants, and tenants.
- What you own & maintain: You own the interior space of your unit (including finishes, doors, windows, and interior utilities) and must maintain it at your own expense. The association maintains the common elements—exterior walls, roofs, landscaping, parking areas, and shared utilities—and carries master property and liability insurance.
- Leasing & rentals: You may lease your entire unit (not just a room) for a minimum term of 30 days. Leases must be in writing, specifically state they are subject to the condominium documents, and define default terms. As the owner, you retain voting rights, and the association may enforce lease violations if you fail to act.
- Pets: Dogs, cats, or other household pets are allowed within your unit, subject to uniform rules adopted by the association. No animal may be bred or kept for commercial purposes.
- Parking & vehicles: Each unit has the exclusive right to one enclosed parking space, assigned by the association. Boats, campers, trailers, and vehicles other than licensed, well-muffled passenger cars or motorcycles are prohibited. Vehicle repair or rebuilding on the property is not allowed.
- Assessments & fees: Each owner pays a proportionate share (1/8) of common expenses, set by the board in regular installments. Late payments incur a $10 fee and 10% annual interest. Special assessments over $0 require approval by owners of at least 51% of the undivided interest (except for damage or condemnation assessments). A working capital fund of two months' estimated expenses is collected at sale.
- Alterations & improvements: Non-structural alterations within your unit may be done without board approval. Structural changes, alterations to common elements (including patios/balconies), and exterior decorations (e.g., paint colors, window coverings) require prior written board approval. The board may charge a reasonable review fee.
- Use restrictions: Units and common elements are for residential use only. No signs visible from outside (except declarent's sales signs), no commercial or professional activity, no nuisances (noise, odors), and no activity that increases insurance rates. The property cannot be further subdivided.
