What Arrowhead Crossing East's governing documents say
Arrowhead Crossing East is a commercial shopping center in Peoria, AZ — not a residential community. This Declaration binds owners of individual parcels or pads within the center, governing use, maintenance, and development of the property. The document sets up a framework for shared common areas, cost-sharing among owners, and restrictions to maintain a cohesive retail environment.
- Permitted uses: The entire shopping center must be used for commercial and retail purposes only. Prohibited uses include warehouses (with exceptions for ancillary storage or warehouse-style retailers), central laundries, massage parlors, churches, and funeral parlors. Specific exclusive rights (e.g., Bank One's branch bank exclusivity) also apply.
- Common area maintenance costs: Owners of obligated parcels pay a pro rata share of Common Area Maintenance Costs based on their gross floor area. Exempt owners (designated by developer) are not required to pay these costs. Costs include insurance, landscaping, utilities, parking area maintenance, and more.
- Exclusive use rights: Bank One (or its successor) has the exclusive right to operate a branch bank in the center; other owners may only have an incidental portion (under 1,000 sq ft or an ATM) of a building used for banking. Other exclusive use rights granted to major tenants (over 10,000 sq ft or nationally recognized retailers) are protected, and use in violation is prohibited.
- Construction & alterations: Any construction, remodeling, or repair must comply with a uniform general plan to maintain architectural compatibility. Prior written notice (30 days) and approval by Declarant (or other owners if Declarant no longer exists) is required, except for emergency repairs or minor work that does not substantially alter exterior appearance.
- Signage & aesthetics: All signs must conform to a master sign criteria package approved by the City and developer. No walls, fences, or barriers that impair access or traffic flow are allowed. Developer may waive or amend signage requirements in its discretion.
- Parking & deliveries: Parking areas are common, and no owner may impose charges for parking. Developers can designate employee parking areas and delivery regulations. Each pad/parcel must provide sufficient parking for its improvements (self-park).
- What this document doesn't cover: This is a commercial property declaration, not a residential rulebook. It does not address residential leasing (no minimum lease terms, pet policies, or age restrictions), and it primarily governs property owners rather than tenants or residents.
