Secluded Acres is a single-family home subdivision in Glendale, AZ, governed by a recorded Declaration of Restrictions that run with the land. These rules apply to all lot owners and set standards for construction, setbacks, fencing, animals, and property maintenance. There is no homeowners association or mandatory fees; enforcement is by property owners or court action.
- Land use & construction: Lots are limited to one single-family dwelling per lot. Minimum enclosed living area is 1,200 sq ft. Exterior walls must be brick, cement block, masonry, or insulated frame. No prefabricated buildings, shacks, or tents are allowed (except temporary sales offices). Roofs cannot be tin, aluminum, or similar materials. Construction must be completed within 12 months, barring delays.
- Setbacks & fences: Front walls must be at least 35 ft from the front property line; side walls at least 15 ft; rear walls at least 30 ft. Fences must be wood, concrete block, pipe, or chain link, built with new materials. Solid walls, fences, or hedges over 4 ft tall cannot be placed nearer the front street than the front wall of the house. Rear 8 ft of each lot is a public utilities and equestrian trail easement, which must be kept clear of weeds and obstructions.
- Animals & livestock: No hogs, poultry, or similar livestock, except up to 4 horses per lot for the owner's personal use, provided there is at least 1,200 sq ft per horse in the corral. Stables and enclosures must be well-built and kept neat. Horse fences/enclosures must be at least 100 ft from the front lot line and 5 ft from side lines. Each lot owner may also keep one goat or one calf if they own at least two contiguous acres. Up to 2 dogs and/or 2 cats are permitted. No animal may be raised for material gain.
- Property maintenance & nuisances: No noxious or offensive trade or activity. No dumping of rubbish; garbage must be in closed containers. No junk, jalopies, or fuselage allowed on lots. Clotheslines, equipment, wood piles must be screened from neighboring lots. Manure must be non-offensive and comply with health regulations. Car repairs are not permitted on lots.
- Prohibited uses: No hospital, sanitarium, or building used for care of persons suffering from disease. No residential use until water flush toilets are installed and all bathrooms are inside the dwelling. Septic tanks must meet county specifications until sewers are available.
- Enforcement & duration: Restrictions run with the land until December 1, 1973, then automatically renew for successive 10-year periods unless a majority of property owners vote to change them. Violations may be restrained by court action and damages awarded; invalidation of one restriction does not affect others. The restrictions do not affect recorded mortgage liens.
