What Avondale Medical Campus's governing documents say
This is a Common Operation and Reciprocal Easement Agreement for Avondale Medical Campus, a commercial/medical office development in Avondale, AZ. It governs the shared use, maintenance, and costs of common areas (parking, landscaping, driveways) among multiple property owners (parcel owners) within the development. The rules apply to commercial property owners and their tenants, not to residential homeowners.
- Easements & Common Areas: All parcels share reciprocal easements for access, parking, utilities, and signage over common areas. Each owner must allow others to use their common areas for these purposes, but cannot obstruct or interfere with others' use.
- Assessments & fees: Common area maintenance costs (landscaping, paving, lighting, etc.) are assessed to each parcel owner based on the gross square footage of their land. Declarant can collect advance impounds, and delinquent assessments become a lien on the parcel with interest at the default rate.
- Use Restrictions: Common areas may only be used for ingress/egress, parking, and loading. No sales, displays, vending machines, carnivals, or political events without Declarant's consent. No nuisance odors, excessive noise, or obstructions permitted.
- Construction & Design Approval: All new buildings, alterations, or exterior changes require prior written approval from Declarant/Developer. Plans must be submitted and conform to architectural harmony. Construction must be completed within 12 months; failure allows Declarant to complete and charge the owner.
- Parking: Parking is limited to designated spaces, and employee parking must be restricted to the owner's own parcel unless otherwise agreed. No reserved parking without Declarant's consent, except handicapped spaces. Late-night lighting costs may be passed to requesting tenants.
- Signage: Pylon signs along McDowell Road are shared and maintained by Declarant. Owners may place sign panels only with Declarant's permission. No other exterior signage without approval.
- Insurance & Indemnification: Each owner must carry property insurance (80% replacement value) and commercial general liability ($2M minimum), naming Declarant and other owners as additional insureds. Owners indemnify each other for acts or omissions on their parcel.
- What this document doesn't cover: This is a commercial reciprocal easement agreement, not a residential HOA or condominium document. It does not address residential living rules (pets, leasing terms, age restrictions, etc.). It focuses on shared commercial property management and development control.
