What Arrowhead Fountains Center's governing documents say
Arrowhead Fountains Center is a commercial planned community in Peoria, Arizona, where individual property owners hold commercial sites under use and architectural restrictions enforced by a property owners' association. The association manages common areas (parking, streets, landscaping, utilities) and collects annual assessments per acre of ownership.
- What you own & maintain: You own your commercial site and are responsible for maintaining your building's exterior, landscaping, and parking—except portions designated as common-area responsibility. All landscaping must be kept neat, irrigated, and regularly maintained; dead plants must be replaced promptly.
- Permitted uses & restrictions: Sites must be used for commercial purposes only, as permitted by city zoning. Prohibited uses include junk yards, salvage yards, and any use creating offensive odors, fumes, dust, smoke, noise, glare, heat, vibration, or pollution. No toxic discharge into public sewers is allowed.
- Architectural review & approval: Any alteration, addition, repair, or change to a building's exterior requires written Board approval. Requests must include plans and specifications; the Board has 45 days to decide—if it doesn't act within that window, approval is deemed granted. Design guidelines cover building size, height, color, landscaping, signage, and screening.
- Parking & vehicles: Each site must have sufficient on-site parking to accommodate all employees, customers, visitors, and company vehicles. Parking on public streets within the property and on Tract G (a private street) is prohibited.
- Assessments & fees: Annual assessments are levied per acre of ownership; the Board sets the amount to cover common expenses. New site buyers pay a working-capital contribution of one-sixth the annual assessment, plus a Board-set transfer fee. Special assessments for major repairs or reconstruction require approval by a 2/3 vote of members.
- Liens & late payment: Assessments become a lien on your site if unpaid within 15 days of the due date; the Board may impose interest and late fees. The association can foreclose the lien and acquire the site; liens take priority over all claims except property tax liens, municipal assessments, and first mortgages.
- Voting & Board control: Each owner votes proportionally based on acreage (one vote per acre). The Declarant appoints the Board while it owns any site; after Declarant ownership ends, the Board is elected by owners. Major decisions like special assessments and common-area conveyances require 2/3 approval.
