Boulder Wash is a small, exclusive homeowners association (HOA) of 8 custom luxury home lots in Peoria, AZ. The Declaration of Covenants, Conditions and Restrictions (CC&Rs) governs all lots and binds owners to strict architectural and use standards. The association enforces rules and levies assessments for common facilities maintenance.
- Architectural review: All exterior changes, including construction, alterations, and landscaping, require prior approval by the Board (all lot owners). Only Southwestern, Territorial, or Mediterranean styles are allowed. Plans must be submitted and are deemed approved after 30 days if no objection.
- Minimum building standards: Principal residences must be at least 4,000 square feet of net livable area. Each home must have a garage for at least three full-size cars (carports prohibited). Lots 1, 6, and 8 are restricted to single-story; other lots allow two stories. Maximum roof height 25 feet on single-story lots. Prohibited roof materials include shake, plastic, metal, and high-gloss tile; clay and concealed roofs are permitted.
- Landscaping requirements: Front yards must be landscaped per an approved plan, with a minimum $5,000 expenditure. At least 50% of front yard must be green grass (or as permitted by city). All areas visible from neighboring property must have 50% green groundcover. Landscaping must be completed within 3 months of home completion and maintained; dead plants replaced within 30 days.
- Parking & storage: No boats, trailers, motor homes, or recreation vehicles may be stored on a lot unless in an enclosed shelter not visible from any street or neighboring property. Garages must be non-front-entry. Construction vehicles must park within the building envelope only.
- Animals: Farm animals and structures for them are prohibited on any lot, except horses are allowed.
- Assessments & fees: Annual assessments are set by the Board with at least 30 days notice. Special assessments require approval of two-thirds of voting members. Assessments not paid within 15 days accrue interest and late fees. The association has a lien on the lot for unpaid assessments, which can be foreclosed. Owners cannot avoid liability by non-use.
- Enforcement: The Board can levy fines for violations after a hearing, secured by the assessment lien. The association or any owner may enforce rules through legal action, and the prevailing party recovers attorney fees. Failure to enforce does not waive rights.
- Duration & amendments: The declaration runs for 20 years from recording (2000), then auto-renews for 10-year periods. Amendment during the first 20 years requires 4/5 of lot owners; after that, 3/5. Amendments must be recorded.
