What Cantatierra's governing documents say
This is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) for Cantatierra, a planned subdivision of single-family detached homes in Scottsdale, AZ. These rules apply to all lot owners and are designed to maintain a high-end, architecturally cohesive residential neighborhood. Key restrictions cover architectural control, minimum home size, landscaping, pets, parking, and signage.
- Architectural review: All exterior improvements, including color changes, fences, and landscaping, require prior written approval from the Architectural Committee. The committee considers aesthetic harmony with surroundings. If no decision within 60 days of final plan submission, the request is deemed approved.
- Residential use & minimum standards: Lots are for single-family residential use only. Each residence must have at least 3,600 square feet of livable area, be one story, and include an enclosed three-car garage. Maximum height is 26 feet. Approved architectural styles are Territorial, Santa Fe, Mediterranean, and similar; all exteriors must be sand or smooth stucco.
- Pets: A reasonable number of domestic pets (e.g., dogs, cats) are allowed, but not for commercial purposes. Pets must not create excessive noise or run loose. Pet structures (e.g., doghouses) must not be visible from neighboring properties.
- Parking & vehicles: All vehicles must be parked inside the garage, except for temporary street parking (4 hours or less). Boats, RVs, trailers, and trucks over ¾ ton are prohibited on the property unless approved. Garages may not be converted to living space.
- Landscaping & natural areas: Front yard landscaping requires an approved plan; no turf or grass is allowed where visible from neighboring properties. Native/xeric plants are encouraged. Areas outside the building envelope must remain undisturbed as natural open space. Owners must keep all landscaping trimmed and free of weeds.
- Signs & antennas: Only limited signs are allowed: one small residential identification sign (≤1 sq ft), one temporary construction or for-sale sign (≤3 sq ft), and signs approved by the committee. Outdoor antennas and satellite dishes require committee approval.
- Maintenance obligations: Each owner is responsible for maintaining their lot and all exterior improvements, including walls, fences, roofs, and landscaping. If an owner fails to maintain, the declarant may perform the work and charge the owner, and that cost becomes a lien on the lot.
