What The Enclave, Village Square at Westbrook Village's governing documents say
The Enclave is a residential subdivision within the larger Westbrook Village master-planned community in Peoria, AZ. This declaration establishes the Enclave Association, which oversees common areas, exterior maintenance, and assessments for lot owners. It is a full set of covenants and restrictions binding all owners.
- Membership & voting: Each lot owner automatically becomes a member with one vote per lot. Declarant holds a Class B membership with three votes per lot owned, which converts to Class A after five years or when Class A votes equal Class B votes.
- Maintenance responsibilities: The Association maintains common areas and paints the exterior of all residential units and fences. Each owner is responsible for all other maintenance of their lot's structures, including roofs, and must keep them in good repair.
- Assessments: The Association levies annual assessments and special assessments. The maximum annual assessment is determined by the Board; special assessments require a member vote if they exceed certain limits. Unpaid assessments are a lien on the lot.
- Insurance: The Association must maintain property insurance on all insurable improvements (replacement cost, 100%), liability insurance of at least $1,000,000 per occurrence, flood insurance if applicable, and fidelity bonds. Individual owners are responsible for their own contents and personal liability.
- Lot Common Use Areas: Portions of lots outside residential units (e.g., sideyards, courtyards) are designated Lot Common Use Areas. These are subject to pedestrian easements for all owners and the Association's right to enter for maintenance. No structures or landscaping may be placed there without Board and Architectural Control Committee approval.
- Party walls: Party walls between residential units are governed by general rules of law: each owner shares repair costs proportionally, and no modification without consent.
- Architectural review: Any exterior changes, landscaping, or structures on a lot require prior written approval from the Architectural Control Committee established under the Master Declaration.
