You own your residential unit and lot, while the association owns and maintains common areas and funds them through assessments; the developer retains enhanced voting control until January 1, 1991, or until member voting power equals developer voting power.
- What you own & maintain: You own your residential unit and lot. The association owns and maintains the common areas (initially Tracts A–E). The association also maintains front-yard landscaping (the portion visible from public roads and common areas) as a common expense; you are responsible for all other exterior maintenance and any structures on your lot.
- Exterior maintenance standards & enforcement: Your home's exterior must be maintained in good condition and consistent with community standards. If the board determines you are in breach, you'll receive written notice with a detailed repair list and 30 days to cure. If not cured, the association may perform repairs and place a lien on your lot for costs plus interest.
- Voting & membership: Each lot holds one Class A membership with one vote (shared if jointly owned). The developer holds Class B membership with 3 votes per lot initially; this converts to Class A membership on January 1, 1991, or when Class A votes equal or exceed Class B votes.
