The Landings at Desert Harbor is a single-family home subdivision in Peoria, AZ, governed by this Declaration of Covenants, Conditions and Restrictions (CC&Rs). It is part of the larger Desert Harbor master-planned community, which has its own Master Declaration and a master association (Sun Harbor Community Association). These rules apply to all lot owners and occupants, and they cover use restrictions, architectural control, and maintenance responsibilities.
- Use of lots: All lots are for single-family residential use only. No business activities are allowed, except for one 'For Rent' or 'For Sale' sign per lot (max 5 sq ft). No noxious or offensive activities. No partition of lots (except judicial sale of jointly owned lots).
- Architectural review: An Architectural Control Committee (ACC) of three members (initially appointed by Declarant) must approve plans for any building, fence, landscaping, color changes, or other alterations before work begins. Approval is deemed given if not rejected within 45 days. The ACC may refuse plans that are not harmonious with the project.
- Pets: Only customary household pets (dogs, cats, birds) are allowed, in numbers that do not create a nuisance. Animals must be kept under control, and waste must be promptly disposed of per local regulations.
- Vehicles & parking: No abandoned, inoperative, or dismantled vehicles. Commercial vehicles, campers, trailers, mobile homes, boats, and RVs cannot be parked where visible from a street, except for temporary parking (up to 4 consecutive hours). Standard pickup trucks used partly for business are allowed if commercial markings are unobtrusive.
- Fences & walls: Fences must be approved by the ACC, typically cement block and no more than 6 ft high. Fences on lot lines are party walls, with shared maintenance costs. Fences damaged by one owner must be repaired at that owner's expense. Disputes go to arbitration.
- Leasing & rentals: Owners have the absolute right to lease their lots and homes, provided the lease is in writing and subject to the Declaration's restrictions. There is no minimum lease term stated in this document.
- Landscaping & maintenance: Landscaping must be installed within 6 months of closing and kept neat. Changes to grade or landscaping require ACC approval. If an owner fails to maintain landscaping, the ACC or Declarant may do the work and charge the owner, plus 15% annual interest, with a lien on the lot.
- Master community compliance: This Declaration is subject to the Desert Harbor Master Declaration. If there is a conflict, the Master Declaration governs. This document's restrictions are additional to and may be more restrictive than the Master Declaration.
