Violations may result in fines, suspension of services or voting rights, self-help remedies, or lawsuits. The company may record a notice of violation against a lot.
- Dispute resolution: Certain disputes (related to development, construction, or management) must first be mediated, then arbitrated if unresolved. The arbitration is binding and non-appealable, with arbitrators limited to awarding either the claimant's or respondent's proposed resolution. Claims not submitted to arbitration within specified deadlines are waived.
- Amendment & termination: The declaration may be amended by a vote of more than 50% of votes in the company, except changes to boundaries, allocated interests, or use restrictions require unanimous consent of affected owners. The project may be terminated by agreement of lot owners holding at least 80% of votes.
