This is a supplementary document (Unit Declaration No. 1) for 7th Gate Center Condominiums, a non-residential (commercial) condominium in Phoenix, AZ. It applies only to Unit 2, which is leased to JPMorgan Chase Bank, and modifies the master declaration to accommodate that tenant's operations.
- Document scope & authority: This is an ancillary amendment to the main Declaration of Condominium. It applies solely to Unit 2 and only while the bank's lease is in effect. The lease terms take priority over this declaration in any conflict.
- Lease controls: The bank's lease governs Unit 2. The association, board, and declarant must not violate the lease and must cooperate with the landlord to meet lease obligations. The unit owner's assessment liability is limited to amounts the tenant must reimburse under the lease.
- Limited common elements: Specific parking and landscaping areas are designated as limited common elements for Unit 2. The unit owner must maintain them but may delegate that responsibility to the tenant under the lease.
- Protected common elements: Certain common elements—security cameras, a secured mailbox, the slab under the unit, and a portion of the parking garage ceiling—are 'protected' for the tenant's exclusive use. The tenant alone may install, repair, and remove improvements in these areas, while the association maintains the underlying common elements.
- Signage rights: The tenant has the right to install and maintain two-sided sign panels on a shared sign, subject to declarant approval and consistent with the bank's standard signage. The tenant also has broad rights to install its standard sign package on the unit or elsewhere on the property.
- ATM & drive-up banking: The tenant may install an ATM on the exterior wall of Unit 2 and a freestanding drive-up ATM in a designated area. Once installed, these become limited common elements and must be removed when the lease ends.
- Maintenance & self-help: If the unit owner or tenant fails to maintain lighting or irrigation in designated areas, the declarant may access the unit to perform maintenance after 10 days' notice. The tenant also has a self-help right under the lease to cure defaults.
- What this document doesn't cover: This document does not contain the full set of rules for the entire condominium. It only modifies the master declaration for Unit 2. It does not address typical residential rules like pets, noise, leasing restrictions for other units, or common area usage beyond what is specified here.
