Aldea Centre is a mixed-use commercial and light industrial development in Phoenix, AZ where you own or lease an individual Lot within a master-planned community. The Master Association maintains common areas (landscaping, signage, drainage) funded by owner assessments. As an owner, you must comply with a Design Review process for any physical changes, carry $5 million in commercial liability insurance, and follow strict use restrictions tied to the underlying PUD and Design Guidelines.
- Permitted business uses: The development permits diverse commercial uses — office, medical, retail, entertainment, hospitality, and light industrial — subject to the underlying PUD (Z-138-C-83-5) and Design Guidelines. All activities must be conducted indoors; outdoor storage is prohibited without approval.
- Prohibited uses: Absolutely prohibited: cemeteries, adult establishments, auction houses, junk yards, stockyards, rendering plants, animal research facilities, oil and gas extraction, smelting, and firearms discharge (except in enclosed retail facilities). The Declarant retains sole discretion over telecommunications towers, heavy industrial, hospitals, and veterinary facilities.
- Design review & approval for improvements: Any physical change to your Lot — construction, signage, landscaping, grading, lighting, remodeling — requires written approval from the Design Review Committee. Submissions are automatically approved within 15 business days if the Committee raises no objection. Unapproved work can be ordered removed, and removal costs (plus 15% supervision fee) assessed against your Lot.
- Insurance you must carry: You must maintain at least $5 million in commercial general liability insurance, naming the Master Association as an additional insured. If you fail to insure, the Master Association may purchase a policy and bill you for the premium as a Special Assessment.
- Maintenance responsibilities: You maintain all improvements on your Lot in first-class condition, including regular cleaning, graffiti removal within five days, and enclosed trash containers. The Master Association maintains common areas, drainage systems, and shared landscaping. You're liable for any damage to common areas caused by your use.
- Assessments & common expenses: The Master Association levies Regular Assessments to cover common area maintenance, utilities, landscaping, insurance, and professional services. Special Assessments may be charged for enforcement costs or insurance failures. Reconstruction Assessments fund repairs to damaged common areas. All assessments create liens against your Lot.
- Environmental compliance & indemnification: You must strictly comply with federal, state, and local environmental laws for handling and disposing of hazardous materials. Any spill or release must be immediately remediated at your expense. You indemnify the Declarant, Master Association, and all other owners for any claims related to hazardous substances from your Lot.
