Encanto at the Legacy is a planned residential community (PUD) in Phoenix where you own your individual house lot and share ownership of common areas (landscaped grounds, streets, drainage easements, parking areas) managed by the association. The community is part of a larger master-planned development called The Legacy and includes an adjacent golf course. You'll pay annual assessments per lot and must adhere to strict architectural review rules for any exterior changes.
- What you own & maintain: You own your dwelling unit and lot; you're responsible for maintaining your home, structures, and improvements in good condition. The association maintains common areas (landscaped areas, streets, drainage easements, parking areas) and shared party walls, funded by member assessments.
- Design review & exterior changes: NO exterior changes of any kind are permitted without written Board approval—this includes painting, landscaping, repairs, patios, storm windows, evaporative coolers, skylights, solar panels, and awnings. The Design Review Committee must respond within 45 days and can specify acceptable design, style, and manufacturer for all improvements.
- Parking & vehicles: Street parking is strictly prohibited; all vehicles must be parked in garages or designated visitor parking areas. Trucks, trailers, campers, boats, and motorized scooters are restricted or prohibited. The association has the right to tow non-compliant vehicles.
- Pets: Only a reasonable number of domestic house or yard pets are allowed; the Design Review Committee determines what qualifies. All pets must be kept on your lot or on a leash at all times, no animals are permitted on the golf course, and owners must immediately remove pet droppings.
- Assessments & fees: Annual assessments are charged per lot for common area maintenance and Master Association costs. Special assessments may be levied for capital improvements; additional fees apply for recreational facilities. Delinquent assessments carry interest and collection costs; violations incur fines and suspension of voting or common area use rights for up to 60 days.
- Use restrictions & nuisances: No temporary buildings, trailers, or tents for residence; no visible clotheslines, signs, or exterior decorations. Garbage must be in approved, covered containers only; no outdoor incinerators. No weeds, debris, offensive odors, or loud exterior speakers (except security devices) are permitted.
- Master Association & governance: Your property is subject to the South Mountain Ranch Master Association and the broader master-planned community called The Legacy. Encanto's association passes all Master Association costs and expenses through to owners as part of annual assessments on a uniform pro-rata basis.
