Autumn Hills West is a single-family home subdivision in Phoenix, AZ — each owner holds fee simple title to their lot, subject to recorded covenants, conditions, and restrictions (CC&Rs) that run with the land for 40 years. These rules govern construction, use, and maintenance and are enforced by the Declarant (builder) and later by homeowners. This document creates binding obligations for all lot owners and their tenants.
- Allowed use & construction: Lots are for single-family residential use only — no businesses, mobile homes, or structures moved onto lots. Each home must be a detached single-family dwelling no more than two stories, with an attached two-car garage. Minimum livable area is 900 sq ft (excluding porch, pergola, garage).
- Architectural review: An Architectural Control Committee (initially named individuals) must approve all plans for new construction, alterations, landscaping, and even paint colors before work begins. The committee's powers expire 10 years after the declaration is recorded; after that, no architectural approval is required.
- Vehicles & parking: Operable passenger vehicles, vans, motorcycles, and small pickup trucks may be parked in driveways for up to one week, then must be garaged. Trailers, RVs, boats, and non-motorized vehicles must be concealed in an enclosed garage. Vehicles not in operating condition cannot be stored on the property.
- Pets: Only 'generally recognized house or yard pets' are allowed — no farm animals or poultry. The number must be reasonable as determined by the Architectural Control Committee. Pets must be leashed when outside the lot and must not create a nuisance. Pet enclosures must not be visible from neighbors.
- Landscaping & maintenance: Front yards must be landscaped within six months of purchase. Landscaping plans need committee approval. Front yard fences/walls/hedges cannot exceed 3 feet; side/rear fences can be up to 6 feet (8 ft along north boundary). All fences must be masonry. Owners must keep lots tidy, store trash containers out of view, and not hang laundry visible from other lots.
- Signs: No signs are visible from the street except traditional mailboxes and small residential nameplates. Any for-sale or for-rent signs must be approved by the Architectural Control Committee.
- Assessments & enforcement: If the committee enforces a rule (e.g., by correcting a violation), the cost becomes a special assessment against that lot, creating a lien. Assessments not paid within 30 days incur 18% annual interest. The lien is subordinate to first mortgages.
