This is a Declaration of Covenants, Conditions and Restrictions (CCRs) for the Bartlett Road 78 subdivision in Pinal County, Arizona. It covers five single-family residential lots (1–5) and binds all current and future lot owners. The rules establish minimum lot sizes, building requirements, and design standards to preserve a rural desert character.
- Residential use & home businesses: All lots must be used for single-family residential purposes only. Commercial businesses are prohibited, but small home businesses are allowed as long as they don't create traffic, regular clientele, or large delivery trucks.
- Lot size, setbacks & subdivision: No lot may be re-subdivided into parcels smaller than 1¼ acres. Building setbacks are 40 feet from the front and rear of any public/private road, and 20 feet from the side. The building envelope may not exceed 50% of the lot, and no more than 50% of the lot may be cleared or disturbed.
- Native landscaping perimeter: A 20-foot wide strip of native/natural desert landscaping must be maintained around the perimeter of each lot, except within 40 feet of the front door where southwestern-themed landscaping is allowed. Ingress/egress drives may cut through this strip only with architectural committee approval.
- Construction standards: All homes must be new construction, not moved from another location. Single-story dwellings must have at least 1,400 square feet of livable ground floor (excluding porches, garages); two-story homes need at least 1,200 square feet on the ground floor and a total of 1,400 square feet. Maximum building height is 30 feet. Construction must be completed within 18 months of permit issuance. Roof styles are limited to built-up roofs with parapets or pitched roofs with quality materials. Exterior colors must be earthtones; blue, green, black, red, yellow, and purple are not allowed. Mobile homes, manufactured homes, and prefabricated homes are prohibited.
- Architectural review & plot plans: Before any construction or alteration, lot owners must submit two copies of detailed drawings (plot plan, floor plan, elevations) to an architectural committee for approval. The drawings must show setbacks, building envelope, walls, heating/cooling units, driveways (side entry required, no frontal entry), and all other improvements. Exterior additions may not exceed 10% of the lot area.
- Vehicles & storage: Inoperative or abandoned vehicles must not be visible from other lots. RVs, boats, and trailers over 25 feet may not be permanently stored on the property. RVs must be garaged or hidden behind block screen walls at least two feet higher than the RV. No commercial equipment may be permanently stored. Satellite dishes may not exceed 18 inches and must be placed inconspicuously; VHF/UHF antennas must be hidden. Items like clotheslines, air conditioners, pool filters, and storage tanks must be screened from neighboring properties.
- Pets & horses: Horses are allowed per Pinal County restrictions. Household pets must be reasonable in number and must not create a nuisance (noise, smell). No animal that causes a nuisance to adjoining properties is allowed.
- Well water & utility easements: Each lot is subject to an easement for ingress, egress, and utilities. If a well serves multiple lots, an easement must be created before construction. Well water cannot be used for commercial purposes, home construction, or off-site use. The lot owner hosting the well or entrance gate is not liable for resulting claims; the HOA is suggested to carry insurance for common easements.
