This is an ancillary covenant that makes each parcel in Skousen Farms (a residential subdivision in Coolidge, AZ) subject to membership in the Central Arizona Groundwater Replenishment District. It imposes water-related fees and liens on every lot, but does not contain typical community rules (e.g., architecture, pets, leasing). The document binds all current and future owners.
- Replenishment Assessment: Each parcel must pay an annual Replenishment Assessment levied by CAWCD, based on the parcel's share of excess groundwater use. This is a continuing lien on the property and a personal obligation of the owner when due.
- Activation Fee: Before a public report authorizing sale or lease of subdivided lands, the owner must pay an Activation Fee to CAWCD, calculated per housing unit as set by CAWCD's board.
- Replenishment Reserve Fee: Each Category 1 member land parcel is subject to a Replenishment Reserve Fee, payable to CAWCD prior to issuance of a public report. This may be satisfied by assigning long-term storage credits in lieu of cash.
- Lien for Nonpayment: Unpaid Replenishment Assessments (plus interest, costs, penalties) become a continuing lien on the parcel and a personal obligation of the owner at the time the assessment came due. CAWCD has statutory remedies for collection.
