Bell West Ranch is a planned community in Phoenix, AZ, consisting of single-family homes governed by a homeowners' association. This document is a second amendment to the governing declaration, enacted in 2002, which modifies certain rules about assessments, developer obligations, and drainage. It does not contain the complete set of community rules.
- Developer & assessment rules: Defines 'Developer' as Standard Pacific of Arizona or any owner building homes who is designated by Declarant. Developers pay only 25% of the annual assessment until lots are sold to retail purchasers, and must pay a subsidy to cover association costs if assessments are insufficient.
- Assessable property & assessment start: Assessments begin when a lot is sold to a retail purchaser (buyer of a completed home). Lots in a phase become assessable only after the first retail sale in that phase. The annual assessment is a uniform dollar amount per lot, levied on January 1.
- Capital reserve fees: All new homebuyers (not developers) must pay an initial capital reserve fee equal to one-sixth of the then-current annual assessment. These funds go to a repair and replacement reserve. The board may later adjust or cease this fee. Reserve studies are required every five years.
- Capital asset definition: A capital asset is any item maintained by the association with a life of 3+ years and a value over $1,000. Groups of similar items (e.g., pool chairs) are aggregated to meet the threshold.
- Drainage & planting restrictions: No structures, landscaping, or other improvements may obstruct or alter drainage. Owners must maintain a 'No Planting or Watering Zone' of at least 3 feet from all concrete to prevent soil expansion damage.
- What this document doesn't cover: This amendment does not address leasing rules, pet restrictions, architectural review, parking, or age restrictions. It modifies only specific assessment, reserve, and drainage provisions of the original declaration.
