Black Canyon Condominiums is a condominium community in Phoenix, AZ — you own your individual unit plus an undivided 1/144th interest in the common elements, which the homeowners' association maintains and insures through assessments paid by all unit owners. This declaration establishes the horizontal property regime and governs use, maintenance, and governance of the community.
- What you own & maintain: You own the interior of your unit (non-structural walls, floor coverings, fixtures, appliances, windows, doors, and HVAC equipment not part of common elements) and must maintain them at your expense. The association maintains structural components, common elements, and utility systems serving more than one unit.
- Assessments & fees: Each unit pays an equal share (1/144) of regular and special assessments set annually by the board. Payments are due monthly by the 15th; late payments bear interest at the highest legal rate. Unpaid assessments become a lien on the unit enforceable by foreclosure.
- Alterations & improvements: Nonstructural interior changes are allowed without board approval if not visible from outside or neighboring areas. Structural changes, or any alteration visible from outside, require prior written board approval and, for structural work, a licensed engineer's certification.
- Party walls: Walls between units are party walls. If you or your guests damage a party wall, you must repair it at your cost. Damage from other causes is repaired by the association. Alterations to party walls need board approval.
- Voting & governance: Each unit gets one vote in the association. Voting rights can be suspended if assessments are unpaid for 15 days after written notice. The board is elected by owners after developer control is transferred.
- Use of common elements: Every owner has an easement to use common elements (recreation areas, walks, parking, etc.), subject to association rules. The association may limit guests, charge fees for facility use, and suspend use rights for rule violations or unpaid assessments.
