What Mountaingate I Condominiums's governing documents say
Mountaingate I Condominiums is a 132-unit condominium community in Phoenix, AZ, established in 1981. You own your individual unit (including a patio or balcony, and sometimes a storage area) plus a proportionate undivided interest in the common elements and a membership in the homeowners association. This declaration sets up the basic ownership structure; detailed rules are in a separate Master Declaration.
- What you own & maintain: You own the airspace of your unit, its patio or balcony, and any assigned storage area. You also hold a proportionate undivided interest in the common elements and a Class A membership in the association – these cannot be separated from your unit.
- Common elements: General common elements include the land, buildings, bearing walls, columns, floors, roofs, recreational facilities, landscaping, pavements, driveways, and utility lines. Limited common elements include certain mail facilities reserved for specific unit owners. Exclusive-use common elements (e.g., parking spaces) are defined in the Master Declaration.
- Association membership: All unit owners automatically become members of the Mountaingate I Condominiums Association, Inc. You cannot exempt yourself from membership or from sharing the cost of common elements, even if you don't use them.
- Proportionate interests: Each unit has a specific percentage interest in the common elements (listed in Schedule B, ranging from about 0.48777% to 2.05612%). This percentage determines your share of common expenses and voting power.
- What this document doesn't cover: This declaration is a foundational document establishing the condominium regime. It does not contain specific rules on leasing, pets, age restrictions, or architectural review. Those are contained in a separate Master Declaration of Covenants, Conditions and Restrictions, which must also be consulted.
