Casa Encantada is a single-family residential community in Phoenix, Arizona. You own your lot and home; the Association maintains common areas, enforces design and use rules through Board approval, and collects annual per-lot assessments. Delinquent assessments or rule violations can suspend your voting rights and access to common facilities.
- Residential use only: All lots are for single-family residential purposes. Limited home-based business allowed if not apparent externally, no customer traffic/parking, and Board-approved. Board has broad authority to interpret and implement these restrictions.
- Pets & animals: A reasonable number of domestic pets allowed; poultry and livestock unconditionally prohibited. Pets must be leashed (≤6 feet) when outside, kept out of common areas, and owners must clean up after them. Pets may not be tied up in common areas. Board determines what qualifies as a "generally recognized" pet.
- Vehicles & parking: Only personal passenger cars/pickup trucks (≤1 ton capacity, ≤84" height/width, ≤222" length) allowed in garage/driveway. Occasional guest overflow on street permitted temporarily; NO street parking 10 PM–6 AM. All other vehicles (RVs, boats, commercial, trailers) prohibited except in Board-approved fully-enclosed garage. No repairs, washing, or construction of vehicles on property except indoors.
- Architectural review & landscaping: Board approval required for landscaping plans, HVAC, solar panels, antennas, and other improvements. You must maintain landscaping on your lot and adjacent public right-of-way areas, debris and weed-free. If your home is destroyed by fire or act of God, you have 18 months to rebuild.
- Trash & nuisances: Trash allowed only in Board-approved covered containers, not visible from neighboring property except temporarily for collection. No outdoor incinerators. No rubbish accumulation, odors, loud/offensive activities, or nuisances. Board has sole discretion to determine violations.
- Party walls & shared structures: If you damage a shared party wall or fence, you pay the full repair cost. If damage occurs from ordinary wear/tear or acts of others, repair costs shared proportionally among affected owners by lot frontage. Party walls cannot be increased or decreased in height. Board arbitrates disputes with binding results.
- Assessments & facility access: Annual per-lot assessments fund Association operations. Delinquent assessments result in suspension of voting rights, common-area facility use, and membership privileges. Rule violations trigger 60-day suspension periods (renewably) until corrected, all subject to Arizona law procedures.
