What Casa La Paloma's governing documents say
Casa La Paloma is a condominium community in Phoenix, AZ, where owners own individual units and share common areas. This document is a 1986 amendment to the Declaration of Restrictions, focusing on the association's enforcement powers and assessment lien rights. It does not contain the full community rules.
- Enforcement & remedies: The association and other owners may sue a defaulting owner for injunction, money damages, and attorneys' fees for violations. Violations continuing 10+ days after notice or occurring repeatedly within 20 days after notice are grounds for action.
- Assessment obligations: Annual and special assessments are due on the first of each month. Unpaid assessments become a lien on the unit and a personal obligation of the owner who owned it when due; personal obligation does not pass to successors unless assumed. Non-use of common areas or abandonment does not waive liability.
- Interest & late charges: Unpaid assessments accrue interest at 18% per annum from the due date. The board may also impose late charges or penalties, enforceable as additional assessments.
- Lien perfection: Recording this amendment constitutes notice and perfection of the assessment lien without further recordation. The lien is exempt from homestead and personal property exemptions.
- Amendment requirement: This amendment was adopted by at least 75% of unit owners, as required by the original Declaration.
- What this document doesn't cover: This is only a partial amendment. The full Declaration of Restrictions, Articles of Incorporation, Bylaws, and Rules and Regulations (not included here) may cover additional topics such as pets, leasing, parking, architectural controls, use restrictions, and maintenance responsibilities.
