Madison Groves Estates is a standard single-family home subdivision in Phoenix, AZ (30 lots). This document is the declaration of covenants, conditions, and restrictions (CC&Rs) that applies to all lot owners and their tenants. It establishes an architectural committee, use restrictions, and maintenance obligations to preserve the residential character.
- Residential use & occupancy: Each lot must be used exclusively for single-family residential purposes. A 'single family' is defined as persons related by blood/marriage/adoption, or up to three unrelated persons maintaining a common household. Home-based businesses are allowed only if not detectable from outside and comply with zoning.
- Architectural review: Any exterior improvement visible from neighboring property (including color changes, fences, landscaping) requires prior written approval from a three-member Architectural Committee (initially appointed by Declarant). The committee can disapprove based on design harmony, aesthetics, and compliance with guidelines. Approval is deemed granted if not acted on within 30 days.
- Minimum building standards: Single-story homes must have at least 1,500 square feet of ground-floor space (excluding garage, porch, balcony, patio, deck). Every home must have a minimum two-car garage enclosed by doors; garages cannot be converted to living space. No carports, mobile homes, manufactured homes, or temporary residences are allowed.
- Pets: Up to two domestic pets (dogs, cats, or similar household birds) per lot are allowed. Pets must be confined to the owner's lot unless on a leash no longer than 6 feet. Nuisance animals or excessive noise are prohibited.
- Vehicles & parking: All motor vehicles owned by residents must be parked in the garage unless insufficient space, then in the driveway. Vehicles exceeding 7 feet in height or 18 feet in length cannot be stored in the driveway (except for loading/unloading limited to 24 hours). Recreational vehicles, boats, and trailers require approval unless stored in a fully enclosed rear yard with a boat cover, not visible from neighboring property. Inoperable vehicles and major repairs visible from neighboring property are prohibited.
- Signs & antennas: No signs visible from neighboring property except for a single approved 'For Sale' sign, residence identification signs, and legal-required signs. Satellite dishes and antennas require prior approval.
- Maintenance & landscaping: Each owner must maintain their lot and improvements in good condition. Landscaping must be installed within 60 days of certificate of occupancy and kept irrigated and trimmed. Dead plants must be replaced. The architectural committee may enforce maintenance by giving 14 days' notice and then performing work at owner's expense.
- Enforcement & amendments: Any owner can enforce the CC&Rs; the prevailing party in litigation recovers attorney fees. The declaration runs for 20 years with automatic 10-year renewals. Termination requires 90% owner approval; amendments require 75% owner approval (or less if Declarant owns >75% of lots).
