McLellan Manor Townhouses is a condominium community of 38 attached townhouse-style units in Phoenix, AZ. You own your individual unit (the interior airspace) plus an undivided 1/38 interest in the common elements; the association maintains the shared structures, grounds, and amenities. This declaration establishes the condominium regime and governs assessments, maintenance responsibilities, alterations, and party walls.
- What you own & maintain: You own the interior of your unit, including finishes, appliances, interior surfaces, windows, doors, and HVAC equipment, and must maintain them at your own expense. The association maintains all common elements, exterior walls, roof, structural components, and shared utilities.
- Assessments & fees: Each owner pays a monthly regular assessment. The initial maximum annual regular assessment was $360 per unit (1981), which can increase annually based on the Consumer Price Index, or by a two-thirds vote of members for larger increases. Special assessments also require a two-thirds vote. Unpaid assessments accrue interest and become a lien on the unit.
- Party walls: Walls shared between units are party walls. If an owner damages a party wall (through negligence or willful act), that owner must pay for repairs. If damage is from other causes, the association covers repairs. Owners must get board approval before modifying a party wall.
- Alterations & improvements: Nonstructural interior alterations do not need prior board approval, but you are liable for any damage caused. Structural alterations, or any change visible from outside the community, require prior written board approval (with an engineer's certification for structural work). Reflective window materials are prohibited without board approval.
