Casa Moderna is a 12-unit condominium in Phoenix, AZ — you own your individual apartment and share ownership of the building's common elements with other owners. The association, governed by a board of directors elected by owners, maintains the common areas and carries master insurance. These bylaws and an amended declaration of restrictions set rules for use, pets, rentals, and children.
- Pets: No animals, pets, livestock, rabbits, fowl, or poultry of any kind may be raised, bred, or kept in any apartment or on the common elements.
- Children: No children or minors may reside in any apartment unless three-quarters of the then owners of record sign a written waiver permitting the residence and specifying the length of stay.
- Leasing & rentals: No apartment may be rented, subleased, or assigned unless three-quarters of the then owners of record sign a written waiver permitting the rental, sublease, or assignment.
- Use of Units: All apartments must be used for residential purposes only. Structural modifications or external alterations require prior written approval from the board (response within 30 days). Unauthorized alterations incur a $300 penalty, plus legal costs and 10% annual interest if unpaid after 10 days' notice, and may result in a lien.
- Assessments & fees: The board sets assessments at least annually, allocated equally per unit as stated in the declaration. Late payments accrue interest at the legal rate and the owner must pay all collection costs, including attorney's fees.
- Board & Meetings: A board of 3–7 owners is elected annually at the February meeting. Owners can call special meetings with a 33⅓% petition. Quorum is a majority of voting owners. Proxies are allowed.
