Lions Gate II is a single-family home HOA in Phoenix, AZ. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) governs all lots in the subdivision and binds all owners. The association maintains common areas and enforces uniform rules to protect property values.
- What you own & maintain: You own your lot and the single-family residence on it. The association maintains common area tracts (Tracts A, B, C), lawns and plantings on common areas, and may enter your lot for maintenance. You must keep your property in good repair; the association can step in after 30 days' notice and charge you.
- Architectural review: All exterior changes (buildings, fences, walls, painting, landscaping, color schemes) need prior written approval from the Architectural Committee. Plans are deemed approved if not decided within 30 days. The committee can reject for aesthetic or harmony reasons.
- Assessments & fees: Annual assessments start at up to $50 per month per lot (as of 1989), adjusted annually by CPI without a vote. Special assessments for capital improvements require a two-thirds vote of each membership class. Unpaid assessments bear 12% annual interest and become a lien on the property.
- Use restrictions: Lots are for single-family residential use only. No business, trade, or non-residential use. No further subdivision. No temporary structures as residences. No antennas outside without board approval. No clotheslines visible from neighbors. No nuisance activities.
- Vehicles & parking: No vehicles over 3/4 ton, mobile homes, travel trailers, boats, campers, or similar equipment may be parked visible from neighboring property, common areas, or streets. Garages must be used for parking and storage only. Only operating vehicles allowed in uncovered parking. Emergency repairs excepted.
- Pets: A reasonable number of generally recognized house or yard pets allowed as domestic pets only (not commercial). Pets must not create excessive noise or nuisance. Pet structures must not be visible from neighboring property. The board determines reasonableness.
- Signs: Only one name/address sign not exceeding 9" x 30"; one temporary 'for sale/rent' sign up to 5 square feet permitted. Builder and association signs allowed otherwise.
- Party walls & fences: Adjoining owners share party walls/fences equally. Damage caused by one owner is repaired at that owner's cost; otherwise joint expense. Disputes may be submitted to the board. Exterior surfaces visible from streets or common areas cannot be painted without architectural committee approval.
