This is a Declaration of Restrictions for Casa Real Phoenix, a single-family residential subdivision in Phoenix, AZ. It imposes deed restrictions on lot owners—there is no homeowners association, but an Architectural Committee oversees exterior changes. These rules apply to anyone who owns a lot here.
- Residential use & minimum building size: Lots may be used only for single-family dwellings. The main structure must have at least 1,000 square feet (excluding porches, garages, patios, exterior stairways). Each lot must be at least 6,000 square feet.
- Animals: Only family dogs and cats are allowed. No farm animals, poultry, or other domestic animals may be kept.
- Architectural review: Before erecting, altering, or placing any building or fence, plans must be submitted to and approved in writing by the Architectural Committee. If the committee fails to act within 30 days, approval is not required unless a lawsuit is filed before construction is complete. The committee reviews style, materials, colors, and harmony with the neighborhood.
- Parking & storage: No motor vehicles, campers, trailers, boats, mobile homes, or junk cars may be stored, repaired, or altered on driveways visible from the street.
- Sight distance & landscaping: On corner lots, no fence, wall, hedge, or shrub between 2 and 6 feet above the roadway may obstruct sight lines within 25 feet of street intersections. Within 10 feet of driveway or alley intersections, similar restrictions apply. Trees must have foliage trimmed to avoid blocking sight lines.
- Nuisance & screening: No noxious or offensive activity may be conducted. Clotheslines, garbage cans, service yards, and storage piles must be screened from view of neighboring properties and streets. Trash must be regularly removed.
- Duration & enforcement: These covenants run with the land for 30 years from recording (1978), then automatically renew for successive 10-year periods unless a majority of lot owners record a change or termination. Any lot owner may enforce the restrictions through legal action.
- What this document doesn't cover: This declaration does not establish an HOA, require assessments or membership, regulate leasing (no minimum lease terms), set age restrictions, or limit the number of pets beyond type.
