What Suntown Terrace Condominium's governing documents say
Suntown Terrace is a 72-unit condominium community in Phoenix, AZ — you own your individual unit plus a 1/72nd undivided interest in the common areas. The association maintains the building exteriors, common elements, and landscaping; you maintain your unit's interior, heating/cooling unit, windows, and fixtures. Assessments are levied per unit and may include annual and special assessments, with a lien for nonpayment.
- What you own & maintain: You own the interior space of your unit (walls-in) and are responsible for interior maintenance, repairs, and termite control. The association maintains all common elements, building exteriors, roofs, and common landscaping, except windows and window fixtures.
- Assessments & fees: Each unit pays an annual assessment (initial maximum not stated) set by the Board, collected monthly (1/12th). Special assessments for capital improvements require Board approval plus 66% member vote. Delinquent assessments bear 8% annual interest and become a lien on the unit, subordinate to first mortgages.
- Leasing & rentals: Leases must be for at least 30 days; transient or hotel use (less than 30 days or with hotel services) is prohibited. Otherwise, owners have the absolute right to lease, subject to all declaration restrictions.
- Pets: Commonly accepted household pets are allowed, but not raised or kept for commercial purposes. No other animals, fish, or birds may be raised, bred, or kept.
- Parking & vehicles: Each unit is assigned one specific carport space as shown on the recorded plat. Trucks, buses, trailers, boats, campers (other than passenger automobiles) are not permitted without prior annual written approval on screening.
- Architectural review: Any improvement, fence, wall, or other structure (including alterations and repainting) requires prior written approval by the Association. Plans are deemed approved if no response within 30 days, but no changes may increase the original square footage of the residence.
- Use restrictions: Units are for single-family residential use only. No business, professional, commercial, religious, or institutional purposes. No temporary structures, noxious activities, or burning of trash. Clotheslines, woodpiles, and storage must be screened from view.
- Party walls: Walls between units are party walls. If damaged by an owner, that owner must repair at own cost. If damaged by other causes, the association repairs. Disputes go to arbitration.
