National Emblem West is a single-family-home subdivision in Phoenix, AZ, governed by a Declaration of Restrictions that runs with the land. These restrictions bind all current and future property owners and outline what you can build, how you can use your lot, and design standards — but they do not create an HOA or impose mandatory fees.
- Permitted use & structures: Lots may be used only for residential purposes. Only one detached single-family dwelling (max two stories) plus a private garage or carport for up to two cars may be built. No mobile homes allowed, but a screened travel trailer may be stored on the rear portion of a lot.
- Minimum house size: Any dwelling must have at least 850 square feet of ground floor area, excluding open porches, pergolas, carports, and garages.
- Setbacks, fences & hedges: Building setbacks must follow Phoenix city ordinances. Front fences or solid walls over 3.5 ft high are prohibited; side/rear fences cannot exceed 6 ft. Hedges over 3 ft cannot be within 2 ft of the front property line.
- Architectural control: No building can be erected or altered until plans are approved in writing by an Architectural Control Committee (initial members named in the declaration). If the committee does not approve or disapprove within 30 days of submission, approval is deemed given.
- Pets & animals: No livestock, poultry, or animals may be raised or kept for commercial purposes. Dogs, cats, and other household pets are allowed but cannot be kept commercially.
- Signs: No signs are allowed in public view except: a developer's sales signs during the development period; one professional sign of up to 1 square foot per lot; or one 'for sale' or 'for rent' sign of up to 5 square feet per lot.
- Leasing & rentals: The declaration does not restrict the length of leases or rental terms; lots may be leased or rented subject to the other restrictions.
- Easements: Utility and drainage easements exist as shown on the recorded plat, plus a 5-foot rear lot easement. No structures, plants, or materials may interfere with utilities or drainage.
